Overview

2017 has turned out to be an exceptionally busy time for insolvency professionals. This programme is part of the Professional Skills Series, designed specifically to give Insolvency Practitioners and Judicial Managers a practical refresher and recent developments in insolvency law.

Programme Outline

Winding Up

  • Winding up application – stay of applications, counterclaims
  • Liquidators – removal, lawsuits by and against liquidators, admitting and rejecting of claims, claims in foreign currency
  • Assets of the company – the anti-deprivation principle (its extent and effects), mistaken payments, retention of title contracts (Romalpa clauses)
  • Voidable transactions - unfair preferences (recent cases, liability of directors)
  • Cross-border problems – foreign creditors and lawsuits, overseas liquidations

Schemes of arrangement

  • Creditors’ approval of schemes – disputed claims; time limit for admitting or rejecting claims
  • Scheme manager – duties, approval of fees; full disclosure to creditors and court
  • Advanced rescue techniques – payment in non-financial assets; early retirement of debt

Judicial management

  • Scope of moratorium
  • Leave from court for recovery of assets – rights of landlords, freight forwarders, etc

Case studies

  • Applicable legislation and cases will be referred to and discussed.

This workshop qualifies for 7.0 CPE hours in Insolvency and Restructuring (Category 4).

Expert Speaker

Terence Tan
LLB (Hons), LLM, ACCA (Grad)​

Terence is an Advocate and Solicitor for over 20 years , and was formerly Asst Professor in the Law Faculty of NUS where he taught Insolvency Law, Company Law and Computer Law.

Terence was named in Parliament in 1995 by the then Minister of Law for his comments on a loophole in the proposed Bankruptcy Act. His comments on bankruptcy legislation were expressly discussed by the High Court and the Court of Appeal.

Besides contributing articles in legal journals, Terence also regularly provides legal training and education for professional organizations, overseas universities and MNCs.
